Amendments of the Ministry of Transport to the law on railway transport may cause a decrease in traffic

The Association of Railway Rolling Stock Operators criticized amendments to federal laws prepared by the RF Ministry of Transport that regulate the operation of rail transport

According to members of the association, the proposed amendments will negatively affect the freight transport industry, lead to the departure of small and medium-sized entrepreneurs from the market and to the transfer of some of the cargo to road transport. This is stated in a response to the bill prepared by the association on behalf of its chairman Andrei Sobolev (the text of the response is at the disposal of TASS).

Earlier, the Ministry of Transport published on the portal for the development of legal acts draft amendments to two federal laws - on railway transport and the charter of railway transport. According to the document, in Russia it is proposed to create a single self-regulatory organization (SRO), which will unite “on the basis of mandatory membership” of all freight operators.

Market sweep

As Sobolev notes, there are more than 300 operator companies in Russia, and most of them fall into the category of small and medium-sized operators. In the case of the creation of a single self-regulatory organization, the number of votes of small companies will be many times greater than that of large operators whose interests as a result will be ignored. On the other hand, the regulatory format, which provides for the presence of only one association of operators in the industry, contains incredible potential for clearing the market from participants with stronger and more influential players, he said.

“After the creation of one SRO, there is an obvious prospect of leaving the market for all medium and small operator companies, which is about 280 operators, providing about 30% of freight transportation on the networks of Russian Railways. The main customers of small and medium operators are medium-sized shippers - about 7,000 legal entities and individual entrepreneurs. The consequence of the withdrawal of small and medium-sized operators from the market will be the gradual departure of small and medium-sized shippers to road transport, "the document says.

Voluntary waiver of income and investment

As a result of the departure of some shippers from the market, the cargo base of Russian Railways will decrease, which will significantly reduce the holding's income. In addition, there will be a sharp decrease in investments in the acquisition of rolling stock - updating the rolling stock in the absence of real competition will become inappropriate. Operators not included in the new SRO or subsequently excluded from it will not be able to fulfill their debt obligations, which will lead to their bankruptcy and deterioration in the balance sheets of banks and leasing companies that have invested in the operator market.

Sobolev emphasizes that the consequence of the artificial decrease in competition in the market for operating wagons will be a sharp increase in the cost of services for the provision of freight wagons for transportation, an increase in fines and toughening settlement conditions.

“In proportion to the decrease in the number of operators, the number of car-building factories and car repair enterprises will decrease, since the remaining operators on the market will no longer need to withstand intense competition and constantly update and expand their fleet of wagons. As a result, the railway industry will be released a large number of qualified employees working in the field of repair and production of railway engineering products, "summed up the chairman of the association.

The market does not need unity

According to Sobolev, the idea of ​​self-regulation in the market of operator services is in principle not feasible. The activities of operator companies directly depend on the activities of the carrier, the owner of the infrastructure, manufacturers of wagons, car repair facilities, and shippers. Moreover, the interests of operators are often multidirectional, and the creation of a single organization means the dictatorship of some operator companies in relation to others.

In recalling the draft federal law, the chairman of the association proposes to exclude from it paragraphs that relate to the creation of such an organization. In addition, he considers it necessary to involve the Federal Antimonopoly Service of Russia, car builders, shippers and representatives of small and medium-sized operators in participating in the development of the draft law.
